TCPA consent

Permission required under the Telephone Consumer Protection Act before sending certain automated calls or text messages to a person.

The TCPA and related FCC rules require prior express consent for many automated or prerecorded calls and texts to mobile phones, and written consent for marketing messages. Recipients must be able to opt out easily, for example by replying STOP, and opt-outs must be honored.

Violations can bring statutory damages per message, so managers should record when and how each contact consented. Some states have their own stricter rules; confirm requirements with counsel.
